Legal authority

The legal authorities are section 338 of the Tariff Act of 1930 (19 U.S.C. 1338); section 301 of title 3, U.S. Code; and section 604 of the Trade Act of 1974 (19 U.S.C. 2483). Section 338 allows additional duties up to 50% ad valorem.

The HTSUS change is made in subdivision (b)(3) of U.S. note 51 to subchapter III of chapter 99 (Annex II). CBP may issue technical corrections to the annexes via Federal Register notice.

How it applies

The duty applies in addition to Section 232 duties (Trade Expansion Act of 1962). Per the White House fact sheet, it applies regardless of whether a good originates under USMCA. Newly added products are exempt if they are civil aircraft or aircraft parts meeting General Note 6 of the HTSUS.

Product descriptions are for information only and do not delimit scope; scope questions go to CBP.

Canada impact

This is a US measure on Canadian exports to the US. As of October 23, 2026, Canada's own surtaxes on US goods are unchanged by this proclamation; this page will be updated if Canada announces changes.

Frequently asked questions

When do the changes take effect?

12:01 a.m. eastern time on October 30, 2026, for goods entered or withdrawn from warehouse for consumption.

What is the rate?

50% ad valorem, in addition to Section 232 duties.

Does USMCA origin exempt goods?

No; the fact sheet says the tariffs apply regardless of USMCA origin.

How many products changed?

100 HTSUS subheadings added, 22 removed.

Are aircraft parts covered?

Newly added articles are not subject to the duty if they are civil aircraft or aircraft parts meeting General Note 6 of the HTSUS.

How do I check if my product is affected?

Use the Am I affected? checker with a 6–10 digit HS/HTSUS code or a product keyword, and confirm the exact HTSUS classification against the added and removed lists. The checker only checks codes changed by the October 23, 2026 proclamation, not the full list already covered under Proclamation 11048 as amended. Confirm your specific goods with CBP or a licensed customs broker.
